STATE OF FLORIDA

DEPARTMENT OF SAFETY AND MOTOR VEHICLES

TO: ALL LA\V ENFORCEMENT AGENCIES AND COUNTY TRAFFIC COURTS

SUBJECT: DEFINITION OF “BUSINESS PURPOSES ONLY” RESTRJCTIONPLACED PLACED ON FLORJDA DRIVER LICENSE

SECTION 322.271, Florida statutes, provides that a driving privilege restricted to business purposes only shall mean any driving necessary to maintain a livelihood, including driving to and from work, necessary on the job driving, driving for educational purposes and driving to church, for medical purposes. Our general Counsel is of the opinion that driving for the purpose of shopping for groceries should be considered necessary to maintain Livelihood. We agree and have instructed our hearing officers to advise drivers as authorized to drive for
business purposes only that grocery shopping is allowed under that restriction.

We are providing this information to you with the request that our policy be considered by law enforcement officers and the Courts when dealing with Florida drivers who have business purposes only restriction on their driver license. We sincerely appreciate your cooperation_

Sincerely,

JAMES H. COX, DIRECTOR DMSION OF DRIVER LICENSES
